1 2 3 4 UNITED STATES DISTRICT COURT 5 DISTRICT OF NEVADA 6 *** 7 KEITH KEMP, Plaintiff, 8 9 10 vs. 11 HOWARD SKOLNIK, et al., 12 Defendants. 13 14 ) ) ) ) ) ) ) ) ) ) ) ) ) 2:09-CV-02002-PMP-VCF ORDER On April 9, 2012, the Court entered an Order (Doc. #69) denying Plaintiff’s 15 Motion for Reconsideration (Doc. #62) and directing that Plaintiff file a response to 16 Defendants’ Motion to Dismiss (Doc. #65) not later than April 24, 2012. To date, 17 Plaintiff has failed to comply with this Court’s Order. As a result, Plaintiff consents 18 to the granting of Defendants’ Motion to Dismiss. Moreover, a review of 19 Defendants’ Motion to Dismiss shows that Defendants are entitled to the relief 20 requested on the merits. 21 IT IS THEREFORE ORDERED that Defendants’ Motion to Dismiss (Doc. 22 #65) is GRANTED and that the Clerk of Court shall forthwith enter judgment in 23 favor of Defendants and against Plaintiff. 24 DATED: April 26, 2012. 25 26 PHILIP M.
