ORDER that Hajocas motion for summary judgment 25 is DENIED. Amerind and Scarboroughs cross-motion for summary judgment 29 is GRANTED IN PART and DENIED IN PART on the following basis: GRANTED as to the payment bond claim, and DENIED as to the u njust enrichment claim. The action having been dismissed as to E. C. Scarborough with respect to the payment bond claim, which is the only claim made by Plaintiff against Scarborough, the action has been concluded as to Defendant Scarborough. Signed by Judge Edward C.
