Pursuant to this Court's July 8, 2011 Order Scheduling Settlement Conference,

18 Defendant Aces High Management, LLC d/b/a Saddle West Hotel, Casino and RV Resort
19 respectfully request an exception to the Settlement Conference Attendance requirements.
20 Saddle West is insured pursuant to a policy of insurance issued by American Zurich
21 Insurance Company. See Exhibit 1, Common Policy Declarations. The policy is subject to
22 a self-insured retention of $100,000.00. See Exhibit 2, Self-Insured Retention
23 Endorsement. Approximately $75,000.00 remains of the self-insured retention. Settlement
24 decisions within the self-insured retention will be made by Saddle West. Saddle West

1 representative Don Hampton will attend the settlement conference in person. Saddle West
2 would request that the American Zurich representative, Jani Lehane be allowed to attend th
