Defendants have consented to Prof. Schultz's appearance. Plaintiff has objected to his appearance. As this Court is aware, Prof. Schultz is an Assistant Clinical Professor of Law and the codirector of the Samuelson Law, Technology & Public Policy Clinic at the University of California's Boalt Hall School of Law.1 On December 15, 2010, this Court granted Prof. Schultz's motion for leave to file an amicus curiae brief, and rescheduled the OSC hearing for December 28, 2010 (Dkt. No. 19). Prof. Schultz respectfully requests the opportunity to make himself available to the Court in case any questions arise from his amicus curiae brief, or from the parties' responses to the brief, and to present a short oral argument regarding the copyright legal and policy issues raised by the Court's OSC. In the alternative, Prof. Schultz could also be available telephonically. For the foregoing reasons, Prof. Schultz respectfully requests that the Court grant his motion for leave to appear and present oral argument in the above-captioned case at the December 28, 2010 hearing.
