The Court having considered Mr. DiBiase’s Motion To File Documents Under Seal, and
good cause appearing therefore,

IT IS HEREBY ORDERED:

The following documents provisionally may be filed under seal using the Court’s

ECF system: (i) the unredacted version of Defendant-Counterclaimant Thomas A. DiBiase’s

6

(“Mr. DiBiase”) Motion to Dismiss for Lack of Subject-Matter Jurisdiction (“Motion to

7

Dismiss”), (ii) the unredacted version of the Declaration of Bart E. Volkmer in support thereof

8

(“Volkmer Declaration”); and (3) Exhibit B to the Volkmer Declaration (“Exhibit B”).

The parties shall meet and confer and file a stipulation regarding which portions,

if any, of the Motion to Dismiss, the Volkmer Declaration, and Exhibit B shall remain under

11

seal. If the parties cannot reach an agreement within 7 days, they shall file a stipulated briefing

schedule for a motion concerning the appropriate confidentiality status of these materials.
