Before the Court is Defendant’s Motion for Waiver of Attendance of Insurance Representative at

Settlement Conference (#40). The settlement conference is scheduled for January 28, 2013.

Background:

Defendant seeks permission to excuse the physical presence of Gary Kopacz, insurance
17
representative for HARCO insurance, at the settlement conference. Id. Defendant states that in order
18
for Mr. Kopacz to appear at the settlement conference, he would have to travel on Sunday from Chicago
19
to Las Vegas in inclement weather.

“representatives from Friendly Ford (which would be partially responsible for any payment) will be

physically present.” Id.

Discussion:

The only explanation for this request is to minimize travel burden and expense. The Court finds
3
that Defendant failed to demonstrate good cause for excusing Mr. Kopacz’s physical attendance from
4
the settlement conference.

IT IS HEREBY ORDERED that Defendant’s Motion for Waiver of Attendance of Insurance

Representative at Settlement Conference (#40) is DENIED.
