Docket ECF No 1. The Complaint (ECF No. 1) alleges the defendant property: a. was furnished or was intended to be furnished in exchange for controlled 21 substances in violation of Title II of the Controlled Substances Act, 21 U.S.C. § 22 801 et seq., and is subject to forfeiture to the United States pursuant to 21 U.S.C. 23 § 881(a)(6). 24 b. is proceeds traceable to exchanges of controlled substances in violation of Title 25 II of the Controlled Substances Act, 21 U.S.C. § 801 et seq., and is subject to 26 forfeiture to the United States pursuant to 21 U.S.C. § 881(a)(6). 1 c. was used or was intended to be used to facilitate violations of Title II of the 2 Controlled Substances Act, 21 U.S.C. § 801 et seq., and is subject to forfeiture 3 to the United States pursuant to 21 U.S.C. § 881(a)(6). 4 On December 22, 2010, the Court entered an Order for Summons and Warrant of Arrest in 5 Rem for the Property and Notice and issued the Summons and Warrant of Arrest in Rem. ECF No. 6 3, ECF No. 4. 7 Pursuant to the Order (ECF No. 3), the Complaint (ECF No. 1), the Order (ECF No. 3), the 8 Summons and Warrant (ECF No. 4), and the Notice of Complaint for Forfeiture (ECF No. 7, p. 9-10) 9 were served on the defendant property and all persons claiming an interest in the defendant property. 10 All persons interested in the defendant property were required to file their claims with the Clerk of the 11 Court no later than 35 days after the notice of this action was sent by mail, followed by the filing of 12 an answer to the Complaint within 21 days after the filing of their respective claims. ECF No. 1, ECF 13 No. 3, ECF No. 4, ECF No. 7, p. 9-10. 14 On February 8, 2011, the United States Marshals Service served the Complaint, the Order, 15 the Summons and Warrant of Arrest in Rem for the Property, and the Notice by executing them on 16 the defendant property. ECF No. 7, p. 2, 9-20. 17 On February 8, 2011, the United States Marshals Service served the Complaint, the Summons 18 and Warrant of Arrest in Rem for the Property, the Order, and the Notice on Brandon Johnson by 19 certified return receipt mail and regular mail. ECF No. 7, p. 3-4, 9-20. 20 On February 8, 2011, the United States Marshals Service served the Complaint, the Summons 21 and Warrant of Arrest in Rem for the Property, the Order, and the Notice on La-Ninja Rockymore by 22 certified return receipt mail and regular mail. ECF No. 7, p. 5-6, 9-20. 23 On February 8, 2011, the United States Marshals Service served the Complaint, the Summons 24 and Warrant of Arrest in Rem for the Property, the Order, and the Notice on Nina Scott by certified 25 return receipt mail and regular mail. ECF No. 7, p. 7-20. 26 ... 2 1 Public notice of the forfeiture action and arrest was given to all persons and entities by 2 publication on the official government website www.forfeiture.gov from April 2, 2012, through May 3 1, 2012. ECF No. 17. 4 5 No other person or entity has filed a claim, answer, or responsive pleading within the time permitted by 18 U.S.C.§ 983(a)(4) and Fed. R. Civ. P. Supp. Rule G(4) and (5). 6 On September 18, 2012, the United States filed a Request for Entry of Default against the 7 defendant property and all persons or entities who claim an interest in the defendant property in the 8 above-entitled action. ECF No. 18. 9 On September 19, 2012, the Clerk of the Court entered a Default against the defendant 10 property and all persons or entities who claim an interest in the defendant property in the above- 11 entitled action. ECF No. 19. 12 13 Brandon Johnson is not in the military service within the purview of the Servicemen’s Civil Relief Act of 2003. Exhibit 1. 14 15 Nina Scott is not in the military service within the purview of the Servicemen’s Civil Relief Act of 2003. Exhibit 2. 16 17 La-Ninja Rockymore is not in the military service within the purview of the Servicemen’s Civil Relief Act of 2003. Exhibit 3. 18 The allegations of the Complaint are sustained by the evidence and are adopted as findings 19 of fact.
