The United States of America (“United States”), by and through Daniel G. Bogden, United

2 States Attorney for the District of Nevada, and Michael A. Humphreys, Assistant United States
3 Attorney, hereby gives notice of the voluntary dismissal of the above-captioned action, pursuant to
4 Fed. R. Civ. P. 41(a)(1). “[T]he plaintiff may dismiss an action without a court order by filing: a
5 notice of dismissal before the opposing party serves either an answer or of a motion for summary
6 judgment....” Fed. R. Civ. P. 41(a)(1)(A)(i). The United States has not served the adverse party, an
7 answer has not been served on the United States, and a motion for summary judgment has not been
8 served on the United States in this action. Accordingly, the United States gives notice of the
9 voluntary dismissal of the action.
