ORDER GRANTING MOTION FOR EXTENSION OF TIME (ECF NO. 152) 10 11 12 WILLIAM GITTERE, et al., Respondents. 13 14 In this capital habeas corpus action, after a 120-day initial period, and extensions 15 of time of 62, 30, 30, and 60 days, the respondents were due to file an answer by 16 February 8, 2022. See Order entered April 12, 2021 (ECF No. 143) (120 days for 17 answer); Order entered August 4, 2021 (ECF No. 145) (62-day extension); Order 18 entered November 1, 2021 (ECF No. 147) (30-day extension); Order entered November 19 8, 2021 (ECF No. 149) (30-day extension); Order entered December 16, 2021 (ECF No. 20 151) (60-day extension). 21 On February 8, 2022, Respondents filed a motion for extension of time (ECF 22 No. 152), requesting a further 62-day extension of time, to April 11, 2022. Respondents’ 23 counsel states that the extension of time is necessary because of his obligations in 24 other cases and time away from work. Petitioner does not oppose the motion for 25 extension of time. 26 The Court finds that Respondents’ motion for extension of time is made in good 27 faith and not solely for the purpose of delay, and that there is good cause for the 28 requested extension of time. 1 Case 2:13-cv-00655-JCM-DJA Document 153 Filed 03/01/22 Page 2 of 2 1 IT IS THEREFORE ORDERED that Respondents’ Motion for Extension of 2 Time (ECF No. 152) is GRANTED. Respondents will have until and including 3 April 11, 2022, to file their answer. 4 IT IS FURTHER ORDERED that Petitioner will have 120 days to file a reply to 5 Respondents’ answer; in all other respects, the schedule for further proceedings set 6 forth in the February 5, 2019, scheduling order (ECF No. 51), will remain in effect. 7 8 DATED March ___ day of ______________________, 2022.
