Case No. 2:13-cv-00657-JAD-NJK
ORDER DISCHARGING
ORDER TO SHOW CAUSE
ORDER THAT THE PARTIES
SUBMIT AN AMENDED INTERIM
STATUS REPORT
Pending before the Court is an order to show cause why Defendants and their counsel should
14
not be sanctioned for failing to participate in the preparation and filing of the interim status report.
15
Docket No. 37. In light of Defendants’ recent request to substitute counsel, see Docket No. 38, it
16
appears that their failure stemmed from the fact that they were in the process of changing counsel.
17
Although that reason does not excuse their failure, the Court concludes that it militates against the
18
sanctions identified in the order to show cause. Accordingly, the order to show cause is hereby
19
DISCHARGED. Defendants and their counsel are cautioned that they must comply with all rules of
20
the Court and Court orders in the future, however, and that failure to do so may result in significant
21
sanctions up to and including case-dispositive sanctions.
22
The Court further ORDERS that Defendants’ new counsel shall promptly contact Plaintiffs’
23
counsel and prepare an amended interim status report. Defendants’ counsel shall file an amended,
24
joint interim status report no later than March 26, 2014.
25
IT IS SO ORDERED.
26
DATED: March 19, 2014
