ORDER that the following claims in the 17 Amended Complaint are dismissed without prejudice for failure to state a claim:(a) Counts I and II(b) the due process claim in Count III(c) all claims against all defendants for monetary damages b ut not injunctive relief in their official capacity Cary Leavitt remains a Defendant in Count III. All other Defendants in the Amended Complaint are Dismissed. Plaintiff shall have 30 days from entry of this Order to file an Amended Complaint. Pl aintiff's 27 Motion for Extension of Time re 17 Amended Complaint is Granted in Part, such that the Court confirms that the time for Plaintiff to effect service is continued until further order of the Court.
