Petitioner shall have 30 days from the date of entry of this order to do one of the following:(1) inform the court that he wishes to dismiss the une xhausted grounds of his 8 petition and proceed only on the remaining grounds for relief;(2) inform the court that he wishes to dismiss the petition to return to state court to exhaust his state remedies; or(3) move to stay this action while h e returns to state court.Petitioner's 34 Motion for Summary Judgment is Denied and Petitioner's 42 Motion for an Order Denying the 23 Motion to Dismiss is Denied.
