Defendant STERLING JEWELERS, INC. (“Defendant”) (collectively the “Parties”) hereby

notify the Court that the Parties have reached an agreement on the terms of a settlement of the

above-captioned action. The Parties expect a Joint Stipulation for Dismissal of the case with
