ORDER regarding 8 Report and Recommendation. Luckett's 6 Amended Complaint is dismissed. His claims for misappropriation of funds, embezzlement, and negligence are dismissed without prejudice. His claims for fraud, extortion, intentiona l infliction of emotional distress, and bad faith are dismissed with prejudice. IT IS FURTHER ORDERED that on or before 11/23/15, Luckett may file a second Amended complaint that cures the deficiencies in his claims. Signed by Judge Andrew P. Gordon on 10/26/15.
