First, Local Rule 26-1(e)(1) establishes 180 days, measured 18 from the date the first defendant answers or otherwise appears, as a presumptively reasonable time to 19 complete discovery. Where more than 180 days of discovery are sought, the proposed discovery plan must 20 state on its face, “SPECIAL SCHEDULING REVIEW REQUESTED” and provide an explanation why 21 the parties believe additional time is required. Local Rule 26-1(d). In this case, the proposed discovery 22 plan requests a longer discovery period than 180 days without complying with Local Rule 26-1. 23 Second, the proposed discovery plan misstates Local Rule 26-4, in that it provides that requests to 24 extend deadlines in the scheduling order need only be filed 21 days before the discovery cut-off. See 25 Docket No. 19, at 3. Local Rule 26-4 requires that any request to extend deadlines set forth in the 26 scheduling order must be submitted at least 21 days before the subject deadline. For example, any request 27 to extend the deadline for initial expert disclosures must be filed at least 21 days before the expiration of 28 that deadline. Such a request filed only 21 days before the discovery cut-off would be untimely. 1 Accordingly, the proposed discovery plan (Docket No. 19) is hereby DENIED without prejudice. 2 The parties shall submit a revised discovery plan no later than August 18, 2015, that complies with the 3 Local Rules. 4 IT IS SO ORDERED. 5 DATED: August 11, 2015 6 7 8 ______________________________________ NANCY J.
