The only 13 pending motion is the government’s motion to alter or amend the judgment, for relief from judgment, 14 and/or stay the proceedings pending trial (ECF No. 39). 15 Pursuant to LR 7-2(d), the failure of an opposing party to file points and authorities in response to 16 any motion, except a motion under Fed. R. Civ. P. 56 or a motion for attorney’s fees, constitutes a consent 17 to the granting of the motion. No opposition has been filed.
