Before the Court is the government’s Motion to Stay Pending Motions (ECF No. 43). The only

pending motion is the government’s motion to alter or amend the judgment, for relief from judgment,

14

and/or stay the proceedings pending trial (ECF No. 39).

Pursuant to LR 7-2(d), the failure of an opposing party to file points and authorities in response to

16

any motion, except a motion under Fed. R. Civ. P. 56 or a motion for attorney’s fees, constitutes a consent

17

to the granting of the motion. No opposition has been filed. Here, it would seem that the other parties

18

have consented to the instant motion.
