Pengilly, and James W. Pengilly, P.C., by and through the undersigned counsel, hereby stipulate as follows1: 19 20 21 1 The plaintiff was dismissed from the action by Order dated November 15, 2015 (Doc 31). 22 1 Case 2:15-cv-01307-JAD-PAL Document 50 Filed 03/06/18 Page 2 of 2 1 1. A settlement conference was conducted by Magistrate Judge Leen in this matter on 2 August 29, 2017. Following the settlement conference, James W. Pengilly filed his federal 3 income tax returns for the years 2013, 2014, 2015 and 2016. In addition, Mr. Pengilly submitted 4 5 amended federal income tax returns for tax years 2008 and 2011 to the Internal Revenue Service for review. 2. The amended federal income tax returns for years 2008 and 2011 have been accepted 6 by the Internal Revenue Service. 7 3. The amount on deposit with the Court in the amount of $230,000 may be distributed 8 9 to the United States for payment towards James W. Pengilly’s federal income tax liabilities for the years 2009, 2011, 2013, 2014 and 2016. 10 4.
