ORDER [Motion to Request An Exception to the Settlement Conference Attendance Requirements (ECF No. 179)] 9 Before the court is Third Party Defendant M&M Construction, Inc.’s Motion to Request An 10 Exception to the Settlement Conference Attendance Requirements (ECF No. 179). 11 The time to file any opposition to the instant motion has passed. (ECF No. 180). No opposition 12 has been filed. Under LR 7-2(d), the failure of an opposing party to file points and authorities in response 13 to any motion, except a motion under Fed. R. Civ. P. 56 or a motion for attorney’s fees, constitutes a 14 consent to the granting of the motion. Here, it would seem that the other parties have consented to the 15 granting of Third Party Defendant M&M Construction, Inc.’s Motion to Request An Exception to the 16 Settlement Conference Attendance Requirements (ECF No. 179). 17 Accordingly, 18 IT IS HEREBY ORDERED that Third Party Defendant M&M Construction, Inc.'s Motion to 19 Request An Exception to the Settlement Conference Attendance Requirements (ECF No. 179) is 20 GRANTED.
