to their respective Motions for Summary Judgment (ECF No. 53 and 54) for three (3) weeks

until February 13, 2017. Both of the parties Motions for Summary Judgment were filed on

January 2, 2017.

Recently, multiple stays have been lifted that add to an abnormally heavy case load at this

8

point in time. Counsel for both Parties are experiencing an abnormally heavy case load and trial

9

preparation as well as multiple motion hearings and depositions that require additional time to

review and analyze the issues presented. This created a delay in review and response.
This is the parties’ first request for an extension of this deadline, and is not intended to cause

12

any delay or prejudice to any party.
