Koppe entered September 10, 2015, recommending that Plaintiff’s action be 18 dismissed pursuant to Federal Rule of Civil Procedure 12(b)(6) for failure to state a claim upon 19 which relief may be granted. Though the time for doing so has passed, Plaintiff has failed to file any 20 objections to the Report and Recommendation. 21 The Court has conducted a de novo review of the record in this case in accordance with 28 22 U.S.C. § 636(b)(1) and LR IB 3-2. The Court determines that the Report and Recommendation (#3) 23 of the United States Magistrate Judge entered September 10, 2015, should be ADOPTED and 24 AFFIRMED. 25 26 IT IS THEREFORE ORDERED that the Magistrate Judge’s Report and Recommendation (#3) entered September 10, 2015, are ADOPTED and AFFIRMED; 1 IT IS FURTHER ORDERED that Plaintiff’s action is DISMISSED without prejudice. 2 DATED this 6th day of October 2015. 3 4 5 6 _____________________________ Kent J.
