Plaintiff Angela L. Hernandez (“Plaintiff”), by and through her counsel of
2 record, and Defendant Capital One Bank (USA), N.A., named as “Capital One Bank
3 (USA) National Association” (“Capital One”), by and through its counsel of record,
4 hereby submit this stipulation to extend Capital One’s time to file a responsive
5 pleading to Plaintiff’s Complaint by fourteen (14) days, as follows:
6 WHEREAS:

Plaintiff filed the Complaint in this matter on September 14, 2015;

2.
The Parties stipulated to extend Capital One’s deadline to respond to the
9 Complaint, and the Court extended Capital One’s deadline until October 22, 2015 and
10 November 21, 2015;

The Parties agree that a further extension of time for Capital One to file
12 its responsive pleading to the Complaint would benefit both Parties because it will
13 allow them to continue to gather additional facts and information while continuing to
14 devote their resources to exploring the potential for early resolution of this matter
15 before incurring further fees and costs;

4.
Capital One and Plaintiff have agreed to seek a fourteen (14) day
17 extension to Capital One’s current deadline, until December 5, 2015, to respond to the
18 Complaint in order to further early settlement discussions;
