ORDER that 11 and 17 Motions to Dismiss are GRANTED. FURTHER ORDERED that all claims are dismissed with leave to amend with the exception of Ms. Kelley's negligence claim against the City of Henderson, which is dismissed with prejudice. FU RTHER ORDERED that Ms. Kelley may file an amended complaint within 21 days of entry of this order if she can allege sufficient facts to address the defects raised in this order.
