Darian Martin commenced this action on December 9, 2015, by filing a “Motion for

Summary Judgment,”1 thus skipping critical steps in the process of this federal lawsuit. On
14
December 31, 2015, I gave Martin until January 15, 2016, to file a proper complaint. I cautioned,
15
“If Martin does not file a complaint by January 15, 2016, this case will be dismissed without
16
further prior notice.”2

Martin did not file a complaint by January 15, 2016.

Accordingly, with good cause appearing and no reason for delay, IT IS HEREBY
19
ORDERED, ADJUDGED, and DECREED that this case is DISMISSED without prejudice.

The Clerk of Court is directed to CLOSE THIS CASE.
