Pursuant to Rule 41(a) of the Federal Rules of Civil Procedure, Plaintiff

21 Charles McCurry (“Plaintiff”) and Defendant Springleaf Financial Services, Inc.
22 (“Springleaf”), move this Court to dismiss with prejudice (i) Plaintiff’s claim against
23 Springleaf only, and (ii) the allegations contained in paragraph 54 of the Complaint
24 (Doc. No. 1), which allegations form the basis of Plaintiff’s claim against Springleaf.
