The complete and precise terms and conditions of the proposed settlement are set forth in the Stipulation for Compromise Settlement and Release of Federal Tort Claims Act Claims 10 Pursuant to 28 U.S.C. § 2677 (“Stipulation”), the Irrevocable Reversionary Inter Vivos Grantor 11 12 Medical Trust for the Benefit of F.N. (“Reversionary Trust”), and the Trust Agreement (“The 13 Cash Trust”) attached as Exhibits A, B, and C. The Court has reviewed the Stipulation, the 14 Reversionary Trust, and the Cash Trust. 15 The Court finds that the terms and conditions of this settlement, as set forth in the 16 17 18 19 20 Stipulation, Reversionary Trust and the Cash Trust are fair, reasonable, and in the best interests of F.N., a minor. IT IS THEREFORE ORDERED, ADJUDGED, AND DECREED: 1. That the settlement, as set forth in Exhibits A, B, and C is hereby approved as 21 fair, reasonable and in the best interests of F.N. 22 23 2. The total amount of settlement for the claims is FOUR MILLION DOLLARS 24 ($4,000,000.00), with extensive terms and conditions required by Defendant, 25 UNITED STATES OF AMERICA, and set forth in the attached Settlement 26 Agreement (Exhibit A) and Reversionary Trust (Exhibit C). The terms as set 27 forth in the Settlement Agreement and the related Trust document are approved. 28 3. The settlement funds, FOUR MILLION DOLLARS ($4,000,000.00) shall be 2 Case 2:16-cv-00217-KJD-PAL Document 115 Filed 09/04/18 Page 3 of 69 1 used to purchase an annuity policy from an annuity company(ies), rated at least 2 “A” by A.M. Best Ratings service, all as more fully described and in 3 accordance with the terms and conditions of the Stipulation For Compromise 5 6 7 8 9 Settlement and Release, which has been approved by the Court. 4. Upon funding, the annuity shall make payment of TWO MILLION DOLLARS AND 00/100 ($2,000,000.00) to Petitioners for and in behalf of F.N. Petitioners shall utilize these funds to pay the following. 10 (a) Attorneys’ fees in the total amount of ONE MILLION DOLLARS AND 11 12 00/100 ($1,000,000.00) with $850,000.00 of the attorneys’ fees payable 13 to Plaintiffs’ counsel, G. Eric Nielson & Associates and $150,000.00 14 payable to The Richard Harris Law Firm, which fees and apportionment 15 is approved by the court. 16 17 (b) Reimbursement to Plaintiffs’ Counsel for case related costs and 18 expenses in the amount of TWO HUNDRED THIRTY-SIX 19 THOUSAND NINE HUNDRED NINETY-FOUR DOLLARS AND 20 71/100 ($236,994.71), which are approved by the court. 21 (c) Repayment of medical subrogation lien to Nevada Medicaid in the 22 23 amount of ONE HUNDRED SEVENTEEN THOUSAND EIGHT 24 HUNDRED FORTY-NINE DOLLARS AND 27/100 ($117,849.27), 25 which is approved by the court. 26 (d) The remaining SIX HUNDRED FORTY-FIVE THOUSAND ONE 27 HUNDRED FIFTY-SIX DOLLARS AND 02/100 ($645,156.02) of the 28 TWO MILLION DOLLARS AND 00/100, referenced in paragraph 4, 3 Case 2:16-cv-00217-KJD-PAL Document 115 Filed 09/04/18 Page 4 of 69 1 2 shall be utilized to fund The Cash Trust on behalf of and for the benefit of F.N., a minor child, as established by the Trust Agreement attached as 3 Exhibit C. 5 6 5. With the remaining TWO MILLION DOLLARS ($2,000,000.00), the annuity, 7 upon funding shall make a lump sum payment of TWO HUNDRED 8 THOUSAND DOLLARS ($200,000.00) to the Irrevocable Reversionary Inter 9 Vivos Grantor Medical Care Trust for the Benefit of F.N. attached as Exhibit B. 10 6. With the remaining ONE MILLION EIGHT HUNDRED THOUSAND 11 12 DOLLARS ($1,800,000.00), the annuity shall make future periodic payments to 13 the Irrevocable Reversionary Inter Vivos Grantor Medical Care Trust for the 14 Benefit of F.N. attached as Exhibit B. 15 7. That, as negotiated in good faith and as a requirement of the Settlement 16 17 Agreement, Petitioners, individually and on behalf of their minor child, F.N. 18 hereby waive any and all claims that they may have or may arise in the future, 19 including potential wrongful death, that may result from the incident outlined in 20 Case Number 2:16-cv-00217-JCM-(PAL). Due to the lack of evidence of any 21 additional future injury to F.N., Petitioners believe it is in the best interest of 22 23 24 25 26 F.N. and their family to waive any potential claims on their own behalf. This waiver is approved by the court. 8. That, pursuant to Nevada Law, Petitioners have presented this compromise to the Fourth Judicial District Court of the State of Nevada in and for the County 27 of Elko and on August 9, 2018, the honorable Alvin R.
