The court denied BANA's motion for summary judgment on July 20, 2017. Pursuant to local 23 rule 26-1(b)(5), the joint pre-trial order was due to be filed within 30 days after an order on a 24 summary judgment motion is entered, or by August 20, 2017. 25 2. 26 27 The parties recognize that the joint pre-trial order is overdue. The parties have held an in person pre-trial conference wherein they have discussed the joint pre-trial order as required by LR 16-3(b). A proposed joint pre-trial order has been circulated amongst all counsel and the parties are 28 in the process of working out the details of the order. 43867801;1 Case 2:16-cv-00422-JCM-PAL Document 64 Filed 01/19/18 Page 2 of 2 3. In the meantime, the parties have also initiated settlement discussions. 2 4. The parties agree that no party will be prejudiced by the late filing of the joint pre-trial order, 3 and that the delay has not been caused by the bad faith of any party nor was it intended to prejudice 4 any party. 1 5 6 5.
