DISCUSSION
On April 5, 2016, Plaintiff submitted a civil rights complaint pursuant to 42 U.S.C.
§ 1983 but did not submit an application to proceed in forma pauperis or pay the filing
fee for this action. (ECF No. 1). On April 6, 2016, the Court ordered Plaintiff to file an
application to proceed in forma pauperis or pay the full filing fee for a civil action. (ECF
No. 2). On April 22, 2016, Plaintiff filed a motion to voluntarily dismiss his complaint in
this Court because he wants to proceed in state court. (ECF No. 3).

Pursuant to Federal Rule of Civil Procedure 41(a)(1), a plaintiff may dismiss an
action without a court order by filing “a notice of dismissal before the opposing party
serves either an answer or a motion for summary judgment.”
41(a)(1)(A)(i).
The Court grants Plaintiff’s motion to voluntarily dismiss this action
because no responsive pleading has been filed in this case.
