following the Ninth Circuit’s decision and submit their position to the Court, as ordered by this

Court on December 20, 2022 (ECF No. 131).

This is the first stipulation for an extension of time to confer regarding the impact of the

Ninth Circuit’s decision on this case. The Parties represent that this stipulation is sought in good

faith, is not interposed for delay, and is not filed for an improper purpose. Accordingly, the
