INTRODUCTION
Defendant Nancy A. Berryhill, Acting Commissioner of Social Security (“Defendant”)
18
19 respectfully requests that the Court extend the time for Defendant to file her Answer to the
20 Complaint, due on July 18, 2017 by 30 days, through and including August 17, 2017.
An extension of time is needed in order to prepare Defendant’s Answer because the
21
Commissioner is still in the process of assembling and finalizing the administrative record. This
22
request is made in good faith with no intention to unduly delay the proceedings. In addition,
23
1
Nancy A. Berryhill is now the Acting Commissioner of Social Security. Pursuant to Rule 25(d) of
the Federal Rules of Civil Procedure, Nancy A. Berryhill should be substituted for Acting
25 Commissioner Carolyn W. Colvin as the defendant in this suit. No further action needs to be taken
to continue this suit by reason of the last sentence of section 205(g) of the Social Security Act, 42
26 U.S.C. § 405(g).
