Docket No. 21. 17 Defendant Duke Partners, LLC filed a response in opposition, and Plaintiffs filed a reply. Docket Nos. 18 26, 30. Plaintiffs are litigating this matter pro se, and the Court construes their filings liberally. See, 19 e.g., Berhardt v. Los Angeles County, 339 F.3d 920, 925 (9th Cir. 2003). Obtaining a default judgment 20 is a two-step process, by which the movant must first obtain default. See, e.g., Eitel v. McCool, 782 F.2d 21 1470, 1471 (9th Cir. 1986); Fed. R. Civ. P. 55. The Court CONSTRUES Plaintiffs’ motion as seeking 22 entry of default.1 Default may be entered when a party has failed to plead or otherwise defend. Fed. R. 23 Civ. P. 55(a). In this case, Defendant Duke Partners, LLC has filed two motions to dismiss and a motion 24 to remand.
