The parties hereby stipulate to entry of an order extending the time for
defendant Hyundai Capital America, doing business as Hyundai Motor Finance

4 (“HCA”), to respond to the complaint by one week, to March 16, 2017.

This is the first stipulation for an extension of time to respond to the complaint.
On September 1, 2016, HCA filed motions to dismiss the complaint or, alternatively,
8 to stay the action pending the D.C. Circuit Court’s ruling in ACA International v.
9 Federal Communications Commission, No. 15-1211 (D.C. Cir., appeal filed July 10,

2015). ECF Nos. 11, 12. On February 23, 2017, the Court issued its Order denying
11
12 the motions. ECF No. 54. Accordingly, pursuant to Rule 12(a)(4)(A) of the Federal
13 Rules of Civil Procedure, HCA’s response to the complaint is due by March 9, 2017.
14
HCA requires a brief extension of time to complete its investigation of plaintiff’s
15
16 claims and to respond to the complaint accordingly.
