On September 1, 2016, HCA filed motions to dismiss the complaint or, alternatively, 8 to stay the action pending the D.C. Circuit Court’s ruling in ACA International v. 9 Federal Communications Commission, No. 15-1211 (D.C. Cir., appeal filed July 10, 10 2015). ECF Nos. 11, 12. On February 23, 2017, the Court issued its Order denying 11 12 the motions. ECF No. 54.
