ORDER that Plaintiff shall file his updated address with the Court no later than June 2, 2017. FURTHER ORDERED that 10 Application for Leave to Proceed in forma pauperis is DENIED as moot. The clerk shall send plaintiff the approved form applicati on to proceed in forma pauperis by a non-prisoner, as well as the document entitled information and instructions for filing an in forma pauperis application. No later than June 2, 2017, Plaintiff shall either: (1) file a fully complete application to proceed in forma pauperis for non-prisoners; or (2) pay the full filing fee of $400. The postal service returned this Court’s last mailing to Plaintiff as 16 undeliverable. (See ECF No. 12). The Court notes that pursuant to Nevada Local Special 17 Rule 2-2, “[t]he plaintiff must immediately file with the court written notification of any change 18 of address. The notification must include proof of service on each opposing party or the party’s 19 attorney. Failure to comply with this rule may result in dismissal of the action with prejudice.” 20 Nev. Loc. Special R. 2-2. This Court grants Plaintiff thirty (30) days from the date of entry of 21 this order to file his updated address with this Court. If Plaintiff does not update the Court with 22 his current address within thirty (30) days from the date of entry of this order, the Court will 23 dismiss this action without prejudice. 24 Additionally, the Court denies the application to proceed in forma pauperis for prisoners 25 (ECF No. 10) as moot because Plaintiff is no longer incarcerated. The Court now directs 26 Plaintiff to file an application to proceed in forma pauperis by a non-prisoner within thirty (30) 27 days from the date of this order or pay the full filing fee of $400. 28 /// 1 2 3 4 5 II. CONCLUSION For the foregoing reasons, IT IS ORDERED that Plaintiff shall file his updated address with the Court no later than June 2, 2017. IT IS FURTHER ORDERED that Plaintiff’s application to proceed in forma pauperis for prisoners (ECF No. 10) is DENIED as moot. 6 IT IS FURTHER ORDERED that the Clerk of the Court SHALL SEND Plaintiff the 7 approved form application to proceed in forma pauperis by a non-prisoner, as well as the 8 document entitled information and instructions for filing an in forma pauperis application. 9 IT IS FURTHER ORDERED that, no later than June 2, 2017, Plaintiff shall either: (1) 10 file a fully complete application to proceed in forma pauperis for non-prisoners; or (2) pay the 11 full filing fee of $400. 12 13 IT IS FURTHER ORDERED that, if Plaintiff fails to timely comply with this order, the Court shall dismiss this case without prejudice. 14 15 DATED: This 3rd day of May, 2017. 16 17 18 _________________________________ NANCY J.
