Counter-defendant Centex Homes (“Centex”) and Counter-claimant Everest National
25 Insurance Company (“Everest”), by and through their respective counsel of record, hereby
26 stipulate to extend the deadline for Centex to file a responsive pleading to Everest’s counterclaim
27 (ECF 51). This is Centex’s second stipulation for an extension of time to file a responsive
28 pleading to Everest’s counterclaim, which is currently due on March 10, 2017.

The basis for this stipulation is that pending before this Court is Defendant St. Paul Fire
2 and Marine Insurance Company’s Motion to Dismiss Centex’s Complaint of lack of subject matter
3 jurisdiction, which affects all parties to this action. Because of St. Paul’s Motion to Dismiss,
4 Centex and Everest hereby stipulate and agree that Centex’s last day to respond to Everest’s
5 counterclaim is 14 days from the date this Court enters its order on St. Paul’s Motion to Dismiss.
