IT IS FURTHER ORDERED that plaintiff shall file, within fourteen (14) days from the entry of this order, a second amended complaint identical to that attached to its motion to amend (ECF No. 63 -1). SFR INVESTMENTS POOL I LLC, et al., 11 Defendant(s). 12 13 Presently before the court is a motion to amend/correct complaint filed by plaintiff Metlife 14 Home Loans, LLC (ECF No. 63). Defendants have not filed a response, and the time to do so has 15 passed. 16 Federal Rule of Civil Procedure 15(a) provides that “[t]he court should freely give leave 17 [to amend] when justice so requires.” Fed. R. Civ. P. 15(a)(2). The United States Supreme Court 18 has interpreted Rule 15(a) and confirmed the liberal standard district courts must apply when 19 granting such leave. In Foman v. Davis, the Supreme Court explained: 20 21 22 23 In the absence of any apparent or declared reason—such as undue delay, bad faith or dilatory motive on the part of the movant, repeated failure to cure deficiencies by amendments previously allowed, undue prejudice to the opposing party by virtue of allowance of the amendment, futility of the amendment, etc.—the leave sought should, as the rules require, be “freely given.” 371 U.S. 178, 182 (1962). 24 Plaintiff has attached a proposed amended complaint to its motion in accordance with Local 25 Rule 15-1(a), which provides that “the moving party shall attach the proposed amended pleading 26 to any motion to amend . . . .” LR 15-1(a). 27 28 James C.
