This request for an extension of time is made to allow counsel for Defendant additional time

to analyze the status of several pending appeals before the Nevada Supreme Court and two petitions

for writ of certiorari before the United States Supreme Court (Epic Systems Corporation v. Jacob

4

Lewis, No. 16-285, U.S. September 2, 2016 and Ernst & Young LLP v. Morris, No. 16-300, U.S.

5

September 8, 2016) that will directly impact the issues raised in this matter.

This is the second request for an extension of time to answer or otherwise respond to the

Amended Complaint and Plaintiff's Motion for Summary Judgment. This request is made in good

faith and not for the purpose of delay.
