ORDER that pursuant to the Court's 2 Screening Order this action shall proceed only against Defendants C/O John Doe when Plaintiff learns his identity, Cox, Bannister, Medical Director John/Jane Doe, Nurse Jane Doe, and Nurse John Doe. Thi s action is STAYED for 90 days to allow Plaintiff and Defendant(s) an opportunity to settle their dispute. If the case does not settle Plaintiff will be required to pay the full $350.00 filing fee. This fee cannot be waived. The Attorney Gene ral's Office shall advise the Court within 21 days of the date of the entry of this order whether it will enter a limited notice of appearance on behalf of Defendants for the purpose of settlement. (ECF No. 2 at 10). The Court 16 granted Plaintiff until November 3, 2017 to file an amended complaint curing the deficiencies 17 of the complaint. (Id.). The Court specifically stated that if Plaintiff chose not to file an 18 amended complaint, the action would proceed only against Defendants C/O John Doe when 19 Plaintiff learns his identity (count I: excessive force); and Cox, Bannister, Medical Director 20 John/Jane Doe, Nurse Jane Doe, and Nurse John Doe (count II: deliberate indifference to 21 serious medical needs). (Id. at 10-11). Plaintiff has not filed an amended complaint. 22 Pursuant to the screening order, this action shall proceed only against Defendants C/O John 23 Doe when Plaintiff learns his identity (count I: excessive force); and Cox, Bannister, Medical 24 Director John/Jane Doe, Nurse Jane Doe, and Nurse John Doe (count II: deliberate 25 indifference to serious medical needs). 26 II. CONCLUSION 27 For the foregoing reasons, IT IS ORDERED that, pursuant to the Court’s screening 28 order (ECF No. 2), this action shall proceed only against Defendants C/O John Doe when Plaintiff learns his identity (count I: excessive force); and Cox, Bannister, Medical Director 1 John/Jane Doe, Nurse Jane Doe, and Nurse John Doe (count II: deliberate indifference to 2 serious medical needs). 3 IT IS FURTHER ORDERED that given the nature of the claim(s) that the Court has 4 permitted to proceed, this action is STAYED for ninety (90) days to allow Plaintiff and 5 Defendant(s) an opportunity to settle their dispute before the $350.00 filing fee is paid, an 6 answer is filed, or the discovery process begins. During this ninety-day stay period, no other 7 pleadings or papers shall be filed in this case, and the parties shall not engage in any 8 discovery. The Court will refer this case to the Court’s Inmate Early Mediation Program, and 9 the Court will enter a subsequent order. Regardless, on or before ninety (90) days from the 10 date this order is entered, the Office of the Attorney General shall file the report form attached 11 to this order regarding the results of the 90-day stay, even if a stipulation for dismissal is 12 entered prior to the end of the 90-day stay. If the parties proceed with this action, the Court 13 will then issue an order setting a date for Defendants to file an answer or other response. 14 Following the filing of an answer, the Court will issue a scheduling order setting discovery and 15 dispositive motion deadlines. 16 IT IS FURTHER ORDERED that “settlement” may or may not include payment of 17 money damages. It also may or may not include an agreement to resolve Plaintiff’s issues 18 differently. A compromise agreement is one in which neither party is completely satisfied with 19 the result, but both have given something up and both have obtained something in return. 20 IT IS FURTHER ORDERED that if the case does not settle, Plaintiff will be required to 21 pay the full $350.00 filing fee. This fee cannot be waived. If Plaintiff is allowed to proceed in 22 forma pauperis, the fee will be paid in installments from his prison trust account. 28 U.S.C. 23 § 1915(b). If Plaintiff is not allowed to proceed in forma pauperis, the $350.00 will be due 24 immediately. 25 IT IS FURTHER ORDERED that if any party seeks to have this case excluded from the 26 inmate mediation program, that party shall file a “motion to exclude case from mediation” on 27 or before twenty-one (21) days from the date of this order. The responding party shall have 28 seven (7) days to file a response. No reply shall be filed. Thereafter, the Court will issue an 2 1 order, set the matter for hearing, or both. 2 IT IS FURTHER ORDERED that the Clerk of the Court shall electronically SERVE a 3 copy of this order, the original screening order (ECF No. 2) and a copy of Plaintiff’s complaint 4 (ECF No. 3) on the Office of the Attorney General of the State of Nevada, by adding the 5 Attorney General of the State of Nevada to the docket sheet. This does not indicate 6 acceptance of service. 7 IT IS FURTHER ORDERED that the Attorney General’s Office shall advise the Court 8 within twenty-one (21) days of the date of the entry of this order whether it will enter a limited 9 notice of appearance on behalf of Defendants for the purpose of settlement.
