HEATHER WILSON, Secretary of the Air Force, Defendant. 9 ORDER (1) GRANTING MOTION TO STRIKE CLAIMS FOR COMPENSATORY DAMAGES, PUNITIVE DAMAGES, AND ATTORNEY’S FEES, AND (2) GRANTING MOTION FOR PARTIAL JUDGMENT ON THE PLEADINGS (ECF Nos. 20, 21) 10 11 Case No. 2:16-cv-02681-APG-GWF Defendant Heather Wilson,1 Secretary of the Air Force, moves to strike plaintiff Jay 12 Singer’s requests in the amended complaint for compensatory damages, punitive damages, and 13 attorney’s fees. ECF No. 20. Wilson argues these types of relief are unavailable under the Age 14 Discrimination in Employment Act (“ADEA”) as applicable to federal employment. Singer does 15 not oppose the motion. ECF No. 23. I therefore grant it. 16 Wilson also moves for partial judgment on the pleadings in relation to Singer’s age 17 discrimination claim under Nevada state law. She argues those statutes do not apply in this case 18 because the ADEA is the exclusive remedy for alleged age discrimination in federal employment. 19 Singer does not oppose the motion. ECF No. 25. I therefore grant it. 20 IT IS THEREFORE ORDERED that defendant Heather Wilson’s motion to strike claims 21 for compensatory damages, punitive damages, and attorney’s fees (ECF No. 20) is GRANTED. 22 IT IS FURTHER ORDERED that defendant Heather Wilson’s motion for partial 23 judgment on the pleadings (ECF No. 21) is GRANTED. 24 25 26 27 28 1 The motions were filed under the name of defendant Lisa Disbrow, who was then acting secretary of the Air Force.
