IT IS HEREBY STIPULATED by and between the parties, through their respective

2

undersigned attorneys, and with the permission of the Court as evidenced below, that this action

3

shall be remanded to the Commissioner of Social Security for further administrative action

4

pursuant to section 205(g) of the Social Security Act, as amended, 42 U.S.C. § 405(g), sentence

5

four.

6

Upon remand from the Court, the Appeals Council will remand the case to an

7

administrative law judge (ALJ) for further proceedings. The ALJ will consider new evidence that

8

the agency had not considered or exhibited because the agency deemed the evidence duplicate.

9

The documents contain evidence not found otherwise in the record, requiring a remand for

10
11

additional administrative proceedings.
The parties further request that the Clerk of the Court be directed to enter a final judgment

12

in favor of Plaintiff, and against Defendant, Commissioner of Social Security, reversing the final

13

decision of the Commissioner.
