POLANGCUS Plaintiff, Case No. 2:17-cv-00163-APG-CWH STIPULATED PROTECTIVE ORDER 21 v. 22 WELLS FARGO BANK, NA; OCWEN LOAN SERVICING, LLC; EQUIFAX INFORMATION SERVICES, LLC; EXPERIAN INFORMATION SOLUTIONS, LLC; TRANS UNION, LLC, Defendants 23 24 25 26 27 1 Case 2:17-cv-00163-APG-CWH Document 23 Filed 05/03/17 Page 2 of 7 1 IT IS HEREBY STIPULATED by and among Plaintiff Crispolo Polangcus 2 (“Plaintiff”) and Defendants EXPERIAN INFORMATION SOLUTIONS, INC 3 (“EXPERIAN”), Trans Union LLC (“TRANS UNION”) and Equifax Information 4 Services, LLC (“EQUIFAX”) (collectively, the “Parties”) through their respective 5 attorneys of record as follows: 6 7 8 9 WHEREAS, documents and information have been and may be sought, produced or exhibited by and among the parties to this action relating to trade secrets, confidential research, development, technology or other proprietary information belonging to the defendants and/or personal income, credit and other confidential information of Plaintiff. 10 11 12 13 THEREFORE, an Order of this Court protecting such confidential information shall be and hereby is made by this Court on the following terms: 1. This Order shall govern the use, handling and disclosure of all documents, 14 testimony or information produced or given in this action which are designated to be 15 subject to this Order in accordance with the terms hereof. 16 2. Any party or non-party producing or filing documents or other materials in 17 this action may designate such materials and the information contained therein subject to 18 this Order by typing or stamping on the front of the document, or on the portion(s) of the 19 document for which confidential treatment is designated, “Confidential.” 20 3. To the extent any motions, briefs, pleadings, deposition transcripts, or 21 other papers to be filed with the Court incorporate documents or information subject to 22 this Order, the party filing such papers shall designate such materials, or portions thereof, 23 as “Confidential,” and shall file them with the clerk under seal; provided, however, that a 24 copy of such filing having the confidential information deleted therefrom may be made 25 part of the public record. Any party filing any document under seal must comply with 26 the requirements of Local Rules. 27 4. All documents, transcripts, or other materials subject to this Order, and all 2 Case 2:17-cv-00163-APG-CWH Document 23 Filed 05/03/17 Page 3 of 7 1 information derived therefrom (including, but not limited to, all testimony, deposition, or 2 otherwise, that refers, reflects or otherwise discusses any information designated 3 Confidential hereunder), shall not be used, directly or indirectly, by any person, including 4 Plaintiff, Trans Union, Equifax or Experian, for any business, commercial or competitive 5 purposes or for any purpose whatsoever other than solely for the preparation and trial of 6 this action in accordance with the provisions of this Order. 7 5. Except with the prior written consent of the individual or entity 8 designating a document or portions of a document as “Confidential,” or pursuant to prior 9 Order after notice, any document, transcript or pleading given “Confidential” treatment 10 under this Order, and any information contained in, or derived from any such materials 11 (including but not limited to, all deposition testimony that refers, reflects or otherwise 12 discusses any information designated confidential hereunder) may not be disclosed other 13 than in accordance with this Order and may not be disclosed to any person other than: (a) 14 the Court and its officers; (b) parties to this litigation; (c) counsel for the parties, whether 15 retained counsel or in-house counsel and employees of counsel assigned to assist such 16 counsel in the preparation of this litigation; (d) fact witnesses subject to a proffer to the 17 Court or a stipulation of the parties that such witnesses need to know such information; 18 (e) present or former employees of the producing party in connection with their 19 depositions in this action (provided that no former employees shall be shown documents 20 prepared after the date of his or her departure; and (f) experts specifically retained as 21 consultants or expert witnesses in connection with this litigation. 22 6. Documents produced pursuant to this Order shall not be made available to 23 any person designated in Subparagraph 5(f) unless he or she shall have first read this 24 Order, agreed to be bound by its terms, and signed the attached Declaration of 25 Compliance. 26 27 7. All persons receiving any or all documents produced pursuant to this Order shall be advised of their confidential nature. All persons to whom confidential 3 Case 2:17-cv-00163-APG-CWH Document 23 Filed 05/03/17 Page 4 of 7 1 information and/or documents are disclosed are hereby enjoined from disclosing same to 2 any person except as provided herein, and are further enjoined from using same except in 3 the preparation for and trial of the above-captioned action between the named parties 4 thereto. No person receiving or reviewing such confidential documents, information or 5 transcript shall disseminate or disclose them to any person other than those described 6 above in Paragraph 5 and for the purposes specified, and in no event shall such person 7 make any other use of such document or transcript. 8 9 10 8. Nothing in this Order shall prevent a party from using at trial any information or materials designated “Confidential.” 9. This Order has been agreed to by the parties to facilitate discovery and the 11 production of relevant evidence in this action. Neither the entry of this Order, nor the 12 designation of any information, document, or the like as “Confidential,” nor the failure to 13 make such designation, shall constitute evidence with respect to any issue in this action. 14 10. After this litigation has concluded by settlement, final judgment, or final 15 order, including all appeals, the non-producing party shall return to the producing party 16 all documents designated as containing “Confidential,” including copies as defined 17 above, within 30-days of receiving a written request from the producing party. The non- 18 producing party is not required to return (1) documents offered into evidence or filed 19 without restriction as to disclosure; (2) materials which in the good faith judgment of 20 counsel are work product materials; (3) communications from Plaintiff to Defendant; (4) 21 consumer file disclosures to Plaintiff that were generated by Defendants; or (5) 22 communications from Defendants to Plaintiff regarding Defendant’s reinvestigations. In 23 lieu of return, the parties may agree to destroy the documents, with certification of 24 destruction. In the event that any party to this litigation disagrees at any point in these 25 proceedings with any designation made under this Protective Order, the parties shall first 26 try to resolve such dispute in good faith on an informal basis. If the dispute cannot be 27 resolved, the party objecting to the designation may seek appropriate relief from this 4 Case 2:17-cv-00163-APG-CWH Document 23 Filed 05/03/17 Page 5 of 7 1 Court. During the pendency of any challenge to the designation of a document or 2 information, the designated document or information shall continue to be treated as 3 “Confidential” subject to the provisions of this Protective Order. 11. 4 Nothing herein shall affect or restrict the rights of any party with respect 5 to its own documents or to the information obtained or developed independently of 6 documents, transcripts and materials afforded confidential treatment pursuant to this 7 Order. 8 9 ... 10 11 ... 12 13 ... 14 15 16 ... 17 18 ... 19 20 ... 21 22 ... 23 24 ... 25 26 27 12.
