Pursuant to LR IA 6-1, LR IA 6-2, and LR 7-1, the parties, by and through their
respective attorneys, stipulate as follows:

Bank of New York Mellon (“Bank”) filed a Motion for Judgment on the
Pleadings on October 4, 2017 (the “Motion”). (ECF No. 22).

Responses to the Motion were due October 18, 2017.

On October 1, 2017, counsel for Braewood Heritage Association, Inc. tragically
27
and unexpected lost a very close family member and was, therefore, out of the office for most
28
of October. The Motion was filed shortly after this event and, while counsel’s firm

proactively continued deadlines as needed, the response deadline for this Motion was
2
inadvertently not calendared. Indeed, even if the response deadline had been calendared,
3
counsel still would have sought this extension, albeit sooner. Counsel learned of this error
4
upon her return and contacted Plaintiff’s counsel, who stipulated to extend the deadline as a
5
professional courtesy. The circumstances under which the response deadline was missed and
6
the calendaring error occurred constitute excusable neglect for the late submission of this
7
stipulation. The circumstances also demonstrate good cause for extending the response
8
deadline.

Therefore, deadline for Braewood Heritage Association, Inc. to respond to the
10
Motion is extended to Tuesday, November 28, 2017.
