Pending before the Court is the parties’ stipulated proposed discovery plan and scheduling

order. Docket No. 11. Under Local Rule 26-1(b)(1),“[u]nless the court orders otherwise, discovery
16
periods longer than 180 days from the date the first defendant answers or otherwise appears will
17
require special scheduling review.” Additionally, “[p]lans requesting special scheduling review must
18
include . . . a statement of the reasons why longer or different time periods should apply to the case.”
19
The parties, however, calculate the discovery cut-off based on a date after the first defendant’s first
20
appearance in this action, without explaining why longer or different time periods should apply to
21
this case. Docket No. 11 at 2. Additionally, the parties misstate Local Rule 26-4. See id.
