The parties 23 have been actively engaged in settlement discussions for several weeks, remain optimistic that 24 they will be able to reach a settlement agreement, and seek the requested additional brief 25 extension of time in hopes that they may resolve this dispute without the need to spend additional 26 resources on litigation. This is the second request for an extension of time to respond to the First 27 Amended Complaint. Defendants’ response currently is due June 12, 2017. 28 1 1 The First Amended Complaint was filed on or about May 3, 2017. YESCO’s counsel 2 accepted service of the First Amended Complaint on May 11, 2017.
