This matter is before the Court on the parties’ failure to file a stipulated Discovery Plan and

Scheduling Order. On August 8, 2017, the Court ordered that the parties file the stipulated Discovery

15

Plan and Scheduling Order on or before August 18, 2017. ECF No. 10. To date, the parties have

16

failed to comply. Accordingly,

17

IT IS ORDERED that the parties shall file a stipulated Discovery Plan and Scheduling Order

18

no later than September 12, 2017. Failure to comply may result in the issuance of an order to show

19

cause why sanctions should not be imposed.
