WHEREAS, the matter is resolved, and the parties are in the process of completing the
final items as set forth in the settlement agreement.
WHEREAS, pursuant to the Court’s order [Dkt#19], the life insurance proceeds at issue
in this matter shall be deposited with the Clerk of the Court and UNUM is released and discharged

from any and all liability to each of the Defendants for the proceeds payable under UNUM’s group
policy number 116090.
WHEREAS, UNUM is preparing and processing the required internal documents to
obtain the check.
WHEREAS, upon receipt of the check, UNUM will prepare a notarized certificate of
deposit and submit to the Court.
WHEREAS, when the funds have been deposited with the Court, UNUM will file a
Notice of Compliance.
WHEREAS, upon service of the Notice of Compliance, the parties will file a Stipulation
and Order to Distribute the Funds and Dismiss with Prejudice.
WHEREAS, the parties request the Court continue the October 11, 2017 scheduling
conference for approximately one month, or the Court’s first available date thereafter, to complete
the terms of the settlement.
IT IS SO STIPULATED.
