ORDER that, pursuant to the Court's screening order (ECF No. 4 ), this action shall proceed on the following claims: Count I will proceed against Defendants Lewis, Gentry, Dzurenda, Knatz, Adams, Dreesen, and Barrit, and will proceed against John Doe doctor, John Doe nurse, and mental health staffer Jane Doe, when Plaintiff learns their identities and amends the complaint to include those identities; the portion of Count II alleging an Eighth Amendment claim for deliberate indifference to serious medical needs will proceed against Defendants Dzurenda and Gentry and will proceed against Defendant Jane Doe mental health staffer when Plaintiff discovers her identity and amends the complaint to include her identity; and the portion of Count II alleging an Eighth Amendment conditions of confinement claim will proceed against Defendants Willis, Jo Gentry, Adams, Dreesen, Lewis, and Dzurenda.FURTHER ORDERED that 6 , 7 Plaintiff's Motions to Exclude from Mediation are g ranted.FURTHER ORDERED that 1 Motion/Application for Leave to Proceed in forma pauperis is granted. The Clerk of the Court shall SEND a copy of this order to the Finance Division of the Clerk's Office, and also to the attention of the Chi ef of Inmate Services for the Nevada Department of Corrections. FURTHER ORDERED that the Clerk of the Court shall electronically SERVE a copy of this order, a copy of Plaintiff's complaint (ECF No. 1-1), and a copy of the screening order (EC F No. 4) on the Office of the Attorney General of the State of Nevada by adding the Attorney General of the State of Nevada to the docket sheet. This does not indicate acceptance of service. Service must be perfected within ninety (90) days from the date of this order pursuant to Fed. R. Civ. P. 4(m). Subject to the findings of the screening order (ECF No. 4), within twenty-one (21) days of the date of entry of this order, the Attorney General's Office shall file a notice advising the Cou rt and Plaintiff of: (a) the names of the defendants for whom it accepts service; (b) the names of the defendants for whom it does not accept service, and (c) the names of the defendants for whom it is filing the last-known-address information under seal. Plaintiff has submitted an application to proceed in forma pauperis and 17 has filed motions to exclude the case from mediation. (ECF No. 1, 6, 7). Based on the 18 financial information provided, the Court finds that Plaintiff is unable to prepay the full 19 filing fee in this matter. The Court also finds that Plaintiff has given sufficient reasons to 20 exclude the case from mediation. 21 DISCUSSION The Court entered a screening order on May 23, 2018. (ECF No. 4). The 22 screening order dismissed some claims with prejudice, dismissed an access to the courts 23 claim without prejudice with leave to amend, and permitted some claims to proceed. (Id. 24 at 16-17). 25 amended complaint curing the deficiencies of the access to the court claim. (Id. at 17). 26 The Court specifically stated that, if Plaintiff chose not to file an amended complaint, the 27 action would proceed on the following claims: Count I will proceed against Defendants 28 Lewis, Gentry, Dzurenda, Knatz, Adams, Dreesen, and Barrit, and will proceed against The Court granted Plaintiff 30 days from the date of that order to file an 1 1 John Doe doctor, John Doe nurse, and mental health staffer Jane Doe, when Plaintiff 2 learns their identities and amends the complaint to include those identities; the portion of 3 Count II alleging an Eighth Amendment claim for deliberate indifference to serious 4 medical needs will proceed against Defendants Dzurenda and Gentry and will proceed 5 against Defendant Jane Doe mental health staffer when Plaintiff discovers her identity 6 and amends the complaint to include her identity; and the portion of Count II alleging an 7 Eighth Amendment conditions of confinement claim will proceed against Defendants 8 Willis, Jo Gentry, Adams, Dreesen, Lewis, and Dzurenda. (Id.) As Plaintiff has not filed 9 an amended complaint, pursuant to the screening order, this action shall proceed on 10 those claims. 11 II. CONCLUSION 12 For the foregoing reasons, IT IS ORDERED that: 13 1. Pursuant to the Court’s screening order (ECF No. 4), this action shall 14 proceed on the following claims: Count I will proceed against Defendants Lewis, Gentry, 15 Dzurenda, Knatz, Adams, Dreesen, and Barrit, and will proceed against John Doe doctor, 16 John Doe nurse, and mental health staffer Jane Doe, when Plaintiff learns their identities 17 and amends the complaint to include those identities; the portion of Count II alleging an 18 Eighth Amendment claim for deliberate indifference to serious medical needs will proceed 19 against Defendants Dzurenda and Gentry and will proceed against Defendant Jane Doe 20 mental health staffer when Plaintiff discovers her identity and amends the complaint to 21 include her identity; and the portion of Count II alleging an Eighth Amendment conditions 22 of confinement claim will proceed against Defendants Willis, Jo Gentry, Adams, Dreesen, 23 Lewis, and Dzurenda. 24 2. 25 granted. 26 3. Plaintiff’s motions to exclude the case from mediation (ECF No. 6, 7) are 27 Plaintiff’s application to proceed in forma pauperis (ECF No. 1) is granted. Plaintiff shall not be required to pay an initial installment of the filing fee. In the event that 28 2 1 this action is dismissed, the full filing fee must still be paid pursuant to 28 U.S.C. § 2 1915(b)(2). 3 4. The movant herein is permitted to maintain this action to conclusion without 4 the necessity of prepayment of any additional fees or costs or the giving of security 5 therefor. This order granting leave to proceed in forma pauperis shall not extend to the 6 issuance and/or service of subpoenas at government expense. 7 5. Pursuant to 28 U.S.C. § 1915(b)(2), the Nevada Department of Corrections 8 shall pay to the Clerk of the United States District Court, District of Nevada, 20% of the 9 preceding month’s deposits to Plaintiff’s account (Lausteveion Johnson, #82138), in the 10 months that the account exceeds $10.00, until the full $350.00 filing fee has been paid 11 for this action. The Clerk of the Court shall SEND a copy of this order to the Finance 12 Division of the Clerk’s Office. The Clerk of the Court shall also SEND a copy of this order 13 to the attention of the Chief of Inmate Services for the Nevada Department of Corrections, 14 P.O. Box 7011, Carson City, NV 89702. 15 6. The Clerk of the Court shall electronically SERVE a copy of this order, a 16 copy of Plaintiff’s complaint (ECF No. 1-1), and a copy of the screening order (ECF No. 17 4) on the Office of the Attorney General of the State of Nevada by adding the Attorney 18 General of the State of Nevada to the docket sheet. This does not indicate acceptance 19 of service. 20 21 22 7. Service must be perfected within ninety (90) days from the date of this order pursuant to Fed. R. Civ. P. 4(m). 8. If the last known address of the defendant(s) is a post office box, the Attorney 3 General's Office shall attempt to obtain and provide the last known physical address(es). 4 9. If service cannot be accepted for any of the named defendant(s), Plaintiff 5 shall file a motion identifying the unserved defendant(s), requesting issuance of a 6 summons, and specifying a full name and address for the defendant(s). 7 defendant(s) as to which the Attorney General has not provided last-known-address 8 information, Plaintiff shall provide the full name and address for the defendant(s). 9 10. For the If the Attorney General accepts service of process for any named 10 defendant(s), such defendant(s) shall file and serve an answer or other response to the 11 complaint within sixty (60) days from the date of this order. 12 11. Henceforth, Plaintiff shall serve upon defendant(s) or, if an appearance has 13 been entered by counsel, upon their attorney(s), a copy of every pleading, motion or other 14 document submitted for consideration by the Court. Plaintiff shall include with the original 15 document submitted for filing a certificate stating the date that a true and correct copy of 16 the document was mailed or electronically filed to the defendants or counsel for the 17 defendants. If counsel has entered a notice of appearance, Plaintiff shall direct service 18 to the individual attorney named in the notice of appearance, at the physical or electronic 19 address stated therein.
