ECF No. 66 15 16 STIPULATION AND ORDER TO EXTEND STAY (Ninth Request) 17 18 Plaintiff, Juaniita Darlynn (hereafter, “Plaintiff”), and Defendant, Department of the Air 19 Force, et al. (hereafter, “Defendant”), by and through their respective counsel, stipulate and 20 agree as follows: 21 1. 22 Plaintiff has an open workers compensation case and in connection therewith requested an Independent Medical Examination (IME) on August 20, 2020. The 23 24 insurer never responded to Plaintiff’s request for an IME and on September 25, 25 2020, Plaintiff filed an appeal of the defacto denial of the request for an IME. 26 That appeal was set for a hearing on February 23, 2021, and at the hearing, the 27 Hearing Officer ordered the workers compensation insurer to approve and 28 schedule the IME. The Order relating to that hearing was dated March 10, 2021. 1 Case 2:17-cv-02800-JAD-VCF Document 67 Filed 12/06/22 Page 2 of 3 2. 1 On May 18, 2021, Plaintiff sent the insurer another request for an IME with Dr. Thomas Shang. The insurer never responded to Plaintiff’s request for that IME 2 3 and on June 22, 2021, Plaintiff filed an appeal of the defacto denial of the request 4 for an IME. That appeal was originally set to be heard by a Hearing Officer on 5 6 September 28, 2021, but the parties stipulated to waive the hearing before the 7 Hearing Officer level and proceed directly to the Appeals Officer level. The 8 Appeals Officer hearing was originally set for November 8, 2021 but was reset 9 to March 29, 2022. The parties agreed to resolve that matter by having the 10 employer’s counsel stipulate to Plaintiff undergoing a Permanent Partial 11 12 Disability evaluation (hereafter “PPD”) during which she would be evaluated, 13 and her injuries apportioned. On August 23, 2022, Jess L. Askeroth, D.C. 14 performed that impairment rating and issued his report. A copy of that report 15 was provided to Troy K. Flake, Esq, counsel for the United States, on August 29, 16 2022. Mr. Flake reviewed the report and settlement negotiations are ongoing. As 17 18 Plaintiff’s worker’s compensation claim just recently concluded, Plaintiff’s 19 counsel is working to obtain subrogation information from the worker’s 20 compensation carrier to evaluate settlement. 21 3.
