This matter is before the Court on Defendant’s Motion to Vacate Minute Order Setting Briefing Schedule (ECF No. 41), filed on April 26, 2018. 14 On November 14, 2017, Plaintiff filed his Application for Leave to Proceed In Forma 15 Pauperis (ECF No. 1) and on November 20, 2017, the Court granted Plaintiff’s Application and 16 instructed the Clerk of the Court to file his Complaint. See ECF Nos. 3, 4. On March 15, 2018, 17 Defendant filed her Motion to Dismiss Plaintiff’s Amended Complaint. ECF No. 26. On April 18 13, 2018, Plaintiff filed his Motion for Summary Judgment (ECF No. 35) and on April 16, 2018, 19 the Court entered a Minute Order regarding the requirements of Klingele v. Eikenberry setting 20 forth the briefing schedule on Plaintiff’s Motion for Summary Judgment. See ECF No. 38. On 21 May 17, 2018, Defendant withdrew her Motion to Dismiss and on May 21, 2018 filed her Answer. 22 See ECF Nos. 42, 43. On May 24, 2018, Defendant filed her notice of manual filing of the 23 administrative record (ECF No. 44) and on May 29, 2018, Defendant filed her notice of filing of 24 the administrative record. ECF No. 45. 25 Defendant submits that Plaintiff’s Motion for Summary Judgment is premature and 26 requests that the Court issue a scheduling order. 27 administrative action by the Secretary of Health and Human Services denying Plaintiff’s claim for 28 Social Security benefits. Whenever Plaintiff files a motion requesting reversal and/or remand, which includes issues based on the administrative record, Plaintiff’s motion shall include: 13 (a) A specification of each and every condition or ailment, or combination of the 14 two, that allegedly renders Plaintiff disabled and is allegedly supported by evidence contained in 15 the administrative record. 16 (b) A complete summary of all medical evidence in the record that supports 17 Plaintiff’s claim of disability due to each condition or ailment specified in subparagraph 5(a) 18 above, with precise references to the applicable portions of the record. This summary shall not 19 include medical evidence unrelated to the conditions or ailments upon which Plaintiff’s claim or 20 claims of disability are based. It shall be sufficient compliance with this subparagraph if Plaintiff 21 shall stipulate that the Administrative Law Judge fairly and accurately summarized the evidence 22 contained in the record. 23 (c) A complete summary of all other evidence adduced at the administrative 24 hearing that supports Plaintiff’s claim with precise references to the applicable portions of the 25 record. It shall be sufficient compliance with this subparagraph if Plaintiff shall stipulate that the 26 Administrative Law Judge fairly and accurately summarized the evidence adduced at the 27 administrative hearing. 28 2 (d) 1 2 3 A complete but concise statement as to why the record does not contain substantial evidence to support Defendant’s claim. 3. If Defendant has not filed a notice of voluntary remand and the issues in question 4 relate to the administrative record, Defendant, within thirty (30) days after being served with 5 Plaintiff’s amended motion for summary judgment, shall file a cross-motion to affirm which will 6 be considered an opposition to Plaintiff’s motion. In the event Plaintiff does not file an amended 7 motion for summary judgment, Defendant shall file a cross-motion to affirm no later than July 8 16, 2018. This motion shall include: 9 (a) A complete summary of all evidence in the record that Defendant contends 10 constitutes substantial evidence to support the administrative determination that Plaintiff is not 11 entitled to the benefits in question. It shall be sufficient compliance with this subparagraph if 12 Defendant stipulates that the Administrative Law Judge fairly and accurately summarized the 13 evidence contained in the record. 14 (b) A complete summary of all testimony adduced at the administrative hearing, 15 including the Administrative Law Judge’s findings, if any, concerning the credibility of witnesses, 16 which Defendant contends constitutes substantial evidence to support the administrative 17 determination that Plaintiff is not entitled to the benefits in question. It shall be sufficient 18 compliance with this subparagraph if Defendant stipulates that the Administrative Law Judge 19 fairly and accurately summarized the testimony adduced at the administrative hearing. 20 (c) A statement as to whether there are any inaccuracies in the summaries filed by 21 Plaintiff. If Defendant believes Plaintiff’s summaries are inaccurate, Defendant shall set forth 22 what additions or corrections are required (with appropriate references to the record) in order to 23 make the summaries accurate. 24 4. The motions filed by Plaintiff and Defendant pursuant to paragraphs 2 and 3 of this 25 Order, respectively, shall also contain appropriate points and authorities dealing with the specific 26 legal issues involved in this case, rather than principles of law applicable to Social Security cases 27 in general. 28 3 1 5. Plaintiff shall be deemed to have acceded to the accuracy of the summaries supplied 2 by Defendant in response to subparagraphs 3(a) and 7(b) of this Order unless within twenty (20) 3 days after being served with Defendant’s motion to affirm Plaintiff shall file and serve a reply 4 brief setting forth: 5 (a) In what manner the summaries are inaccurate; 6 (b) What additions or corrections are required (with appropriate references to the 7 8 record) in order to make the summaries accurate. 6. The motions filed by both Plaintiff and Defendant shall also contain the following: 9 (a) A statement as to whether the transcript of the administrative hearing can be 10 adequately comprehended in spite of the fact that such transcript may contain the words 11 “inaudible” or “unintelligible” in one or more places, and specifying each page, if any, in which 12 testimony relating to the particular issues of this case cannot be adequately comprehended. 13 (b) A specification of each page in the administrative record that is partially or 14 totally illegible, and a statement whether each such illegible page contains information relevant to 15 an understanding of any issue presented in this case. 16 7. Oral argument shall be deemed waived and the case shall stand submitted unless 17 argument is ordered by the Court or requested pursuant to Local Rule 78-2, by one of the parties 18 within ten (10) days following the filing of the last document required by this Court. It shall be 19 at the Court’s discretion whether oral argument is granted. 20 8. Failure of a party to file a motion or points and authorities required by this Order 21 may result in dismissal of the action or reversal of the decision of the Secretary of Health and 22 Human Services.
