Case No.: 2:17-cv-02966-GMN-NJK
ORDER
9
10
Pending before the Court is the Motion for Reconsideration, (ECF No. 47), filed by
11
Defendant Charles M. Hallinan and Defendant Hallinan Capital Corp. (collectively,
12
“Defendants”), in which Defendants request clarification of the Order, (ECF No. 45), issued by
13
the Honorable Kent J. Dawson or, alternatively, dismissal of this case to allow it to proceed in
14
the proper tribunal. Subsequent to the filing of Defendants’ Motion, the case was transferred to
15
the undersigned, pursuant to the Court’s Omnibus Transfer Order, (ECF No. 50). Thereafter,
16
on August 9, 2019, Defendants filed a Motion to Stay Proceedings, (ECF No. 99), pending the
17
resolution of their Motion for Reconsideration, (ECF No. 47), or in the alternative, to amend
18
the scheduling order to extend the dispositive motions deadline. On September 13, 2019,
19
Defendants and Plaintiff filed their respective Motions for Summary Judgment, (ECF Nos. 108,
20
111).
21
Accordingly, because the Omnibus Transfer Order, (ECF No. 50), eliminates the need for
22
the relief requested in Defendants’ Motion for Reconsideration, (ECF No. 47), IT IS HEBEBY
23
ORDERED that the Motion for Reconsideration, (ECF No. 47), is DENIED as moot.
