ORDER. IT IS HEREBY ORDERED 7 SFR Investments Pool 1, LLCs Demand for Security of Costs is GRANTED. In the event that the cost bond is presented for deposit, the CLERK OF COURT is directed to accept the deposit of $500.00 from Plaintiff Citimortgage, Inc., under NRS 18.130, as security for costs and charges that may be awarded against the plaintiff. 1 UNITED STATES DISTRICT COURT 2 DISTRICT OF NEVADA 3 *** 4 5 6 CITIMORTGAGE, INC., 7 Plaintiff, 8 9 10 vs. SFR INVESTMENTS POOL 1 LLC, 2:17-cv-03003-KJD-VCF ORDER Defendant. 11 12 13 Defendant SFR Investments Pool 1, LLC has demanded that Plaintiff Citimortgage, Inc., an out- 14 of-state resident, post a cost bond of $500 under NRS 18.130(1). The statute allows a defendant in an 15 action brought by an out-of-state plaintiff to demand that the plaintiff post a bond to secure costs up to 16 $500. Once the demand is filed and served, “all proceedings in the action shall be stayed” until the cost 17 bond is deposited. If the bond is not posted within 30 days of the demand, the defendant may move for 18 dismissal. Because a court order is required in this district for the Clerk of Court to permit the posting of 19 a cost bond, the demand is tracked as a motion in the court’s system. 20 Accordingly, with good cause appearing, IT IS HEREBY ORDERED SFR Investments Pool 1, 21 LLC’s Demand for Security of Costs (ECF No. 7) is GRANTED. In the event that the cost bond is 22 presented for deposit, the CLERK OF COURT is directed to accept the deposit of $500.00 from Plaintiff 23 Citimortgage, Inc., under NRS 18.130, as security for costs and charges that may be awarded against the 24 plaintiff. The plaintiff must bring a copy of this order to the Clerk’s office when making this deposit. 25 1 2 3 IT IS FURTHER ORDERED that this case is stayed by operation of NRS 18.130(1) until the cost bond from plaintiff is deposited.
