1 UNITED STATES DISTRICT COURT 2 DISTRICT OF NEVADA 3 *** 4 ELEMENT THERAPEUTIC MASSAGE, LLC, 5 Plaintiff, 6 7 vs. CHERLYN WHITE, et al., 8 2:18-cv-00269-APG-VCF ORDER Defendants. 9 Before the Court is Plaintiff’s Motion to Extend Time to Serve Defendant Cherlyn White (ECF 10 11 No. 25). 12 Plaintiff seeks a 1 week extension to complete service by publication on Defendant White because 13 the four week publication period ends 3 days after May 14, 2018, the 90-day time limit of Rule 4(m). 14 Extension For Service 15 Fed. R. Civ. P. 4(m) requires a defendant to be served within 90 days after the complaint is filed. 16 If “the plaintiff shows good cause for the failure [to serve a defendant within that time-frame], the court 17 must extend the time for service for an appropriate period.” Fed. R. Civ. P. 4(m). 18 19 Here, Plaintiff has given good cause for the court to grant an extension to serve Defendant Cherlyn White. 20 Accordingly, 21 IT IS HEREBY ORDERED that Plaintiff’s Motion to Extend Time to Serve Defendant Cherlyn 22 White (ECF No. 25) is GRANTED. 23 24 25 IT IS FURTHER ORDERED that the deadline to effect service of process is extended up to and /// 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 including May 22, 2018.
